DATAAVATAR TERMS

These DataAvatar Terms ("DataAvatar Terms") govern access to and use of the DataAvatar functionality, Digital Double systems, psychometric features, AI-generated profile functionality, avatar-related systems, assessments, and related features made available through the Services ("DataAvatar Features").

These DataAvatar Terms supplement and form part of the CampusAI Terms of Service ("Terms"). Capitalized terms not defined in these DataAvatar Terms have the meanings given in the Terms, Privacy Policy, or applicable Additional Terms.

DataAvatar Features may include:

• AI-generated profile functionality;
• Digital Doubles;
• avatar-related systems;
• psychometric and personality-related functionality;
• AI-generated summaries and contextual representations;
• workflow-related insights;
• AI-assisted interactions;
• profile-based AI responses;
• assessments;
• reports; and
• related AI-powered functionality.

DataAvatar Features are optional and are not required in order to use other parts of the Services.

DataAvatar Features are intended solely for informational, educational, experimental, collaboration, self-development, productivity, workflow, or AI-assistance purposes. DataAvatar Features are not intended to provide medical, psychological, psychiatric, therapeutic, legal, financial, employment, recruiting, compliance, or other professional advice or services.

DataAvatar Features are not medical devices, diagnostic tools, psychological assessment services, recruiting systems, employment decision systems, or licensed professional services.

By accessing or using DataAvatar Features, users acknowledge that:

• AI Systems may generate inaccurate, incomplete, probabilistic, non-deterministic, or misleading Outputs;
• Outputs may vary over time or across AI models;
• AI-generated representations may not accurately reflect real individuals;
• psychometric or personality-related functionality may involve subjective, inferred, estimated, contextual, or non-scientific interpretations; and
• users are solely responsible for evaluating Outputs and determining whether such Outputs are appropriate for their intended use.

1. DataAvatar Profiles and Assessments

Certain DataAvatar Features may allow users to create, upload, generate, maintain, update, or interact with DataAvatar profiles, psychometric information, assessments, behavioral information ("Avatar Profiles").

Avatar Profiles may include:

• profile information;
• biographies and descriptions;
• preferences;
• behavioral patterns;
• collaboration-related information;
• strengths and weaknesses;
• communication styles;
• personality-related information;
• psychometric information;
• assessment results;
• interaction history;
• contextual information;
• uploaded content; and
• AI-generated summaries or representations.

Certain DataAvatar Features may involve psychometric, behavioral, or personality-related functionality based on:

• questionnaires;
• self-assessments;
• uploaded information;
• interaction patterns;
• AI-generated analysis; or
• third-party assessment methodologies.

Such functionality may reference or incorporate frameworks, methodologies, models, or concepts associated with personality, behavioral, psychometric, collaboration, productivity, strengths, communication, or workflow systems, including systems commonly referred to as MBTI, DISC, Big Five, Gallup, or similar methodologies.

CampusAI does not guarantee the scientific validity, reliability, objectivity, completeness, or accuracy of any psychometric, behavioral, personality-related, or AI-generated Outputs.

Users acknowledge that:

• assessments and Outputs may be subjective, inferred, estimated, probabilistic, contextual, incomplete, or inaccurate;
• different AI Systems or methodologies may generate different Outputs or interpretations;
• Outputs may evolve over time as additional information is processed; and
• DataAvatar Features are not intended to establish factual, medical, psychological, psychiatric, employment, or professional conclusions about any individual.

Users are solely responsible for determining what information is submitted to DataAvatar Features and whether such information is appropriate for the intended use case.

Users may update, modify, export, or delete certain Avatar Profile information through available functionality, subject to technical limitations, retention practices, security requirements, legal obligations, and operational considerations.

2. AI Systems and Avatar Interactions

DataAvatar Features may use AI Systems, orchestration systems, contextual processing systems, automation systems, and third-party AI Providers to generate Outputs, interactions, summaries, recommendations, contextual responses, workflow assistance, avatar-related interactions, and AI-generated representations.

Depending on the functionality used, users may interact with:

• AI-generated representations;
• AI-generated summaries;
• AI-assisted workflows;
• profile-based AI systems;
• conversational AI systems; or
• other AI-powered functionality.

Certain DataAvatar Features may generate Outputs based on:

• Avatar Profiles;
• uploaded information;
• psychometric information;
• contextual information;
• user activity;
• AI-generated inferences; and
• interactions with AI Systems.

AI-generated Outputs may include:

• summaries;
• recommendations;
• insights;
• behavioral interpretations;
• workflow suggestions;
• communication suggestions;
• contextual responses;
• AI-generated representations;
• synthetic content; and
• avatar-related interactions.

DataAvatar Features may support interactions between users and AI-generated systems designed to simulate, represent, summarize, contextualize, or approximate aspects of user-provided information, workflows, communication styles, collaboration patterns, or contextual signals.

Users acknowledge that:

• AI-generated interactions may not accurately reflect real individuals;
• AI Systems may generate fictional, inaccurate, incomplete, misleading, inconsistent, or hallucinated Outputs;
• Outputs may differ between AI Systems, providers, or versions;
• AI-generated Outputs may change over time;
• AI Systems may generate similar Outputs for different users; and
• AI-generated interactions should not be interpreted as factual statements, guarantees, diagnoses, verified representations, or professional conclusions.

CampusAI does not guarantee:

• the accuracy of Outputs;
• continuity of Outputs;
• uniqueness of Outputs;
• scientific validity of Outputs;
• reliability of avatar-related interactions; or
• consistency between AI Systems or providers.

Certain DataAvatar Features may involve automated Processing, contextual AI analysis, profiling-related functionality, AI-generated interpretations, or AI-assisted recommendations based on information submitted through the Services.

Users are solely responsible for:

• reviewing Outputs;
• verifying information;
• determining whether Outputs are appropriate for intended use cases;
• evaluating whether to rely on Outputs; and
• controlling the information submitted to DataAvatar Features.

3. User Responsibilities and Restrictions

Users are solely responsible for:

• the information submitted to DataAvatar Features;
• the legality of submitted content;
• obtaining all necessary rights, permissions, authorizations, and consents relating to submitted information;
• evaluating Outputs and AI-generated interactions;
• determining whether DataAvatar Features are appropriate for intended use cases; and
• complying with applicable laws, regulations, agreements, and third-party rights.

Users must not:

• submit unlawful, infringing, deceptive, abusive, discriminatory, harmful, or misleading content;
• use DataAvatar Features in violation of applicable law;
• use DataAvatar Features for unlawful profiling, discrimination, manipulation, harassment, or exploitation;
• use DataAvatar Features as the sole, primary, or determinative basis for decisions relating to employment, recruiting, promotion, termination, compensation, insurance, creditworthiness, education, healthcare, legal determinations, or other decisions producing legal or similarly significant effects concerning individuals;
• use DataAvatar Features for medical diagnosis, psychiatric evaluation, therapeutic treatment, employment screening, recruiting decisions, insurance decisions, credit decisions, legal determinations, or other regulated activities;
• impersonate other individuals without authorization;
• submit information relating to third parties without an appropriate legal basis;
• attempt to reverse engineer, extract, replicate, or misuse underlying AI Systems except as expressly permitted by applicable law; or
• use DataAvatar Features in a manner that violates the Terms, applicable Additional Terms, or third-party AI Provider terms.

Users should not submit:

• highly sensitive information;
• special categories of personal data under GDPR;
• medical records;
• financial account information;
• government-issued identifiers;
• trade secrets;
• confidential business information; or
• other regulated or high-risk information

unless expressly authorized or supported by the applicable functionality.

Where users submit psychometric, behavioral, personality-related, assessment-related, or other potentially sensitive information, users represent that they have knowingly and voluntarily chosen to provide such information and understand that such information may be processed by AI Systems and third-party AI Providers as described in the Privacy Policy and applicable Additional Terms.

Users must be at least eighteen (18) years old, or such higher minimum age required under applicable law in the user's jurisdiction, to access or use DataAvatar Features unless otherwise expressly permitted by CampusAI in writing.

Users are solely responsible for any decisions, actions, reliance, disclosures, communications, or consequences resulting from the use of DataAvatar Features or AI-generated Outputs.

4. Third-Party AI Providers and External Systems

DataAvatar Features may involve integrations with third-party AI Providers, model providers, orchestration systems, cloud providers, hosting providers, infrastructure providers, assessment-related systems, analytics systems, or related technologies.

Depending on the functionality used, information submitted through DataAvatar Features may be processed by one or more third-party AI Providers located in multiple jurisdictions, including outside the European Economic Area.

Such Processing may involve:

• prompts;
• profile information;
• psychometric information;
• avatar-related content;
• interaction history;
• uploaded content;
• contextual information;
• workflow information;
• AI-generated Outputs; and
• related metadata.

Third-party AI Providers may process information in accordance with their own:

• privacy policies;
• terms of service;
• retention practices;
• security practices;
• compliance procedures;
• operational requirements; and
• model improvement practices.

CampusAI does not control the independent policies, retention practices, infrastructure, operational decisions, model behavior, or Processing practices of third-party AI Providers.

Users acknowledge that:

• certain information may be processed outside their jurisdiction;
• AI Providers may use automated systems and infrastructure outside CampusAI's control;
• Outputs may be influenced by provider-specific systems, methodologies, moderation systems, or model behavior; and
• different providers may generate different Outputs or interpretations.

CampusAI does not intentionally use information submitted through DataAvatar Features to train proprietary AI models owned or controlled by CampusAI unless expressly stated otherwise in applicable Terms, settings, or functionality disclosures.

However, certain third-party AI Providers may process, retain, analyze, improve, or use information in accordance with their own terms, privacy policies, and model improvement procedures depending on the functionality or AI Systems selected or used by users.

Users are responsible for reviewing and determining whether specific AI Providers, workflows, systems, or functionality are appropriate for their intended use cases.

5. Intellectual Property and Outputs

Subject to applicable law, the Terms, applicable Additional Terms, and the policies or terms of applicable AI Providers, users may generally use Outputs generated through DataAvatar Features for their own lawful internal, personal, educational, informational, workflow, productivity, collaboration, or business purposes.

Users retain ownership of information and content they submit to DataAvatar Features, subject to the rights necessary for CampusAI and applicable third-party providers to operate, provide, maintain, secure, improve, and support the Services and DataAvatar Features.

Certain Outputs, avatar-related interactions, summaries, recommendations, contextual representations, or AI-generated content may:

• be generated using third-party AI Systems;
• contain similarities to content generated for other users;
• be non-exclusive;
• incorporate probabilistic or inferred elements;
• be influenced by training data or provider-specific systems; or
• be subject to provider-specific restrictions, licenses, or terms.

CampusAI does not guarantee that Outputs:

• are unique;
• are protectable under intellectual property laws;
• do not infringe third-party rights;
• are suitable for exclusive commercial use; or
• will remain continuously available.

Users are solely responsible for:

• reviewing Outputs;
• determining whether Outputs are appropriate for intended use;
• evaluating intellectual property implications;
• verifying factual accuracy; and
• ensuring compliance with applicable law and third-party rights.

Except as expressly permitted under the Terms or applicable law, users may not:

• copy, extract, reproduce, distribute, reverse engineer, scrape, or exploit underlying AI Systems, DataAvatar Features, models, orchestration systems, or proprietary functionality;
• use DataAvatar Features to compete directly with CampusAI; or
• misuse AI-generated Outputs or avatar-related systems in violation of applicable law or the Terms.

6. Suspension, Deletion, and Termination

Users may stop using DataAvatar Features at any time.

CampusAI may suspend, restrict, disable, or terminate access to DataAvatar Features:

• to protect the Services, users, systems, or infrastructure;
• to comply with applicable law or legal obligations;
• to investigate suspected misuse, abuse, fraud, security incidents, or unlawful activity;
• where required by third-party AI Providers or infrastructure providers;
• for operational, security, compliance, or technical reasons; or
• where users violate the Terms, applicable Additional Terms, or applicable law.

Certain information may continue to be retained following deletion, suspension, or termination where reasonably necessary for:

• legal compliance;
• security;
• fraud prevention;
• abuse prevention;
• dispute resolution;
• backup systems;
• operational continuity;
• enforcement of agreements; or
• legitimate business purposes.

Deletion of Avatar Profiles or DataAvatar-related information may not immediately remove:

• cached information;
• backup copies;
• logs;
• AI-generated Outputs previously shared with users;
• de-identified information; or
• information retained by third-party AI Providers in accordance with their own policies and practices.

In the event of a conflict between these DataAvatar Terms and the Terms, these DataAvatar Terms control solely with respect to DataAvatar Features.

Where required by applicable law, CampusAI may make reasonable efforts to request deletion of applicable information from third-party AI Providers or subprocessors. However, CampusAI cannot guarantee deletion from systems, backups, logs, models, infrastructure, or environments outside CampusAI's reasonable control.

7. Privacy and Data Processing

Processing of personal information in connection with DataAvatar Features is governed by the Privacy Policy, DPA (where applicable), and these DataAvatar Terms.

Depending on the functionality used, DataAvatar Features may involve Processing of:

• profile information;
• psychometric information;
• personality-related information;
• behavioral information;
• contextual information;
• communications;
• avatar-related content;
• uploaded content;
• AI-generated Outputs;
• interaction history; and
• workflow-related information.

Certain DataAvatar Features may involve Processing of psychometric, behavioral, profiling-related, assessment-related, personality-related, or potentially sensitive information voluntarily submitted by users.

Where required under applicable Data Protection Laws, including GDPR, UK GDPR, or similar laws, CampusAI processes such information on the basis of:

• user consent;
• explicit consent where required;
• user instructions;
• performance of a contract;
• legitimate interests; or
• other lawful bases permitted under applicable law.

Users acknowledge that:

• DataAvatar Features may involve AI-generated inferences, contextual analysis, profiling-related functionality, or probabilistic Outputs;
• AI-generated Outputs may not accurately reflect real individuals;
• certain information may be processed by third-party AI Providers; and
• Processing may occur across multiple jurisdictions as described in the Privacy Policy.

CampusAI implements reasonable safeguards designed to protect information processed through DataAvatar Features. However, users acknowledge that AI Systems, Digital Doubles, orchestration systems, virtual environments, integrations, and third-party AI Providers may involve additional operational, technical, privacy, or security risks outside CampusAI's reasonable control.

Users remain solely responsible for determining:

• what information is submitted to DataAvatar Features;
• whether such information is appropriate for intended use cases; and
• whether specific AI Systems or functionality are appropriate for their intended purposes.

8. Miscellaneous

These DataAvatar Terms may be updated from time to time in accordance with the Terms.

CampusAI may modify, suspend, discontinue, replace, update, or limit certain DataAvatar Features, AI Systems, AI Providers, assessments, workflows, integrations, or functionality at any time.

Certain DataAvatar Features may be designated as experimental, beta, preview, research, early access, or evolving functionality and may contain additional limitations, instability, inaccuracies, interruptions, or operational risks.

To the maximum extent permitted by applicable law:

• DataAvatar Features are provided "as is" and "as available";
• CampusAI disclaims warranties and representations relating to DataAvatar Features; and
• the liability limitations and exclusions set forth in the Terms apply to DataAvatar Features.

If any provision of these DataAvatar Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

These DataAvatar Terms form part of the Terms and should be interpreted together with:

• the Terms;
• the Privacy Policy;
• the DPA (where applicable); and
• other applicable Additional Terms.

Users acknowledge that certain AI-powered functionality, profiling-related systems, Digital Doubles, psychometric functionality, or AI-generated representations may be subject to evolving laws, regulations, regulatory guidance, or AI-specific compliance requirements in certain jurisdictions, including under emerging AI regulatory frameworks.
